Terms of Use
1. Agreement
These Terms of Use (“Terms”) are an agreement between you and Pants Brothers LLC, a Georgia limited liability company (“we,” “us”), for the Fieldmiles mobile app and the website fieldmiles.com (together, “Fieldmiles”). By downloading or using Fieldmiles, you agree to these Terms. If you don’t agree, don’t use Fieldmiles.
2. What Fieldmiles does
Fieldmiles is a mileage tracker. It records drives on your phone, lets you mark them as business or personal, and, with Pro, exports mileage reports. We may add, change, or remove features over time.
3. Not tax or legal advice
Fieldmiles, including its mileage totals, deduction estimates, the IRS mileage rates it applies, and the calculator on this website, is provided for your convenience. It is not tax, legal, accounting, or financial advice. We work to keep IRS rates current and cite irs.gov, but we don’t guarantee that any figure is correct or right for your situation. Check current rates at irs.gov and talk to a qualified tax professional before relying on any report.
4. Your records are your responsibility
Automatic tracking depends on your phone’s location services, settings, signal, and battery. Drives can be missed, split, or measured inaccurately. You are responsible for reviewing your drives, correcting errors, classifying them accurately, and keeping the records you need for taxes, reimbursement, or anything else.
Your trips are stored on your device and in your own iCloud or Google backup, not with us. We can’t recover trips that are deleted or lost. Keep your backups turned on and save exported reports you need.
5. Drive safely
Don’t use or look at Fieldmiles while driving. Fieldmiles is designed to work in the background so you don’t have to. Always obey traffic laws.
6. Purchases and subscriptions
- Free and Pro. Fieldmiles has a free version and a paid Pro upgrade, available as a yearly subscription or a one-time lifetime purchase. Prices are shown in the app store before you buy.
- Billing by Apple or Google. All purchases are made through the Apple App Store or Google Play and are billed to your store account under that store’s terms.
- Renewal and free trials. The yearly subscription renews automatically until you cancel. If you start a free trial, it becomes a paid subscription when the trial ends unless you cancel before then, following your app store’s cancellation timing.
- Managing and canceling. Manage or cancel your subscription in your App Store or Google Play account settings. Deleting the app does not cancel a subscription.
- Refunds. Refunds are handled by Apple or Google under their refund policies. We can’t issue refunds directly.
- Lifetime purchase. A lifetime purchase unlocks Pro for as long as we offer Fieldmiles on that app store, on devices signed in to the store account you bought it with. Because Fieldmiles has no account, purchases don’t transfer between iPhone and Android.
7. License
We give you a personal, limited, non-exclusive, non-transferable, revocable license to use the Fieldmiles app on devices you own or control, as allowed by the app store’s usage rules. You may not copy, modify, distribute, sell, reverse engineer, or attempt to extract the source code of Fieldmiles, except where the law allows it. We and our licensors keep all rights not expressly granted.
8. App store terms
Your use of Fieldmiles must also follow the terms of the app store you got it from. If you got Fieldmiles from the Apple App Store:
- These Terms are between you and us, not Apple. We, not Apple, are responsible for Fieldmiles.
- Apple has no obligation to provide maintenance or support for Fieldmiles.
- If Fieldmiles fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent the law allows, Apple has no other warranty obligation for Fieldmiles.
- Apple is not responsible for addressing any claims by you or a third party relating to Fieldmiles, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection claims, or intellectual property infringement claims.
- You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
9. Privacy
Our Privacy Policy explains what information Fieldmiles uses. In short: no account, and we never see your trips.
10. Disclaimers
Fieldmiles is provided “as is” and “as available.” To the maximum extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don’t promise that Fieldmiles will be uninterrupted, error-free, or that it will record every drive.
11. Limitation of liability
To the maximum extent the law allows, Pants Brothers LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, tax penalties, interest, or disallowed deductions, arising from your use of Fieldmiles. Our total liability for any claim relating to Fieldmiles is limited to the greater of the amount you paid for Fieldmiles in the 12 months before the claim or US $50. Some places don’t allow these limits, so they may not apply to you.
12. Ending use
You can stop using Fieldmiles at any time by deleting the app and canceling any subscription. We may suspend or end your license if you break these Terms.
13. Governing law
These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Bryan County, Georgia, and you and we consent to those courts’ jurisdiction, except where the law gives you the right to bring a claim elsewhere.
14. Changes to these Terms
We may update these Terms. We’ll post the new version on this page and update the effective date. If you keep using Fieldmiles after a change, you accept the updated Terms.
